my cousin used my checkcard and gambled on pokerstars on thee internet and now i owe usbank 1300 dollars in fees and they are going to close my account. what chould i do?. I got a 250 loan from checksmart and they sent it to my bank for payment but my bank returned it back to them because my account has a negitive balance. i feel like **** now i only make 9 dollars an hour there is now way i can payback checksmart or pay back usbank. what will happen to me if i dont pay ? someone please help me i live in ohio. helpppp mmeeee please someone.

You can call your credit card company and let them know that the charge was made without your permission. It is likely you will need to file a fraud charge, and this may impact on your cousin. But maybe it could be a good chance to teach him a lesson he won't forget.

Definitely contact the authorities and file charges against your cousin. Don't feel bad because it's your cousin, your cousin obviously could have cared less about you since s/he stole your card. In the meantime, to avoid damaging your credit further, contact USBank and file a Regulation E claim for fraudulent check card use. Don't let this sit, if they close your account it'll likely get reported to chexsystems making it harder for you to open a bank account anywhere in the future. The bank can also give you further advice regarding this whole situation.



Like the first answerer said, it's likely you'll be responsible for the fees in the eyes of the bank. Make sure you pay them back, they should be able to set up a payment schedule for you. The only way to get your cousin to pay is to have a judgement made against him/her.

You will need to file a fraud report with your bank and check with your local police to see if the amount is enough to file a police report.

Sadly, in this situation, you will either have to claim responsibility and pay off the debts yourself. (hoping your cousin will pay you back) Or, your only other option is to take legal action against them.
