Question:
I bought an electrical item with a credit card. The item has developed an intermittent fault. Twice within 17 days of purchase the fault?

manifested itself. I take to the vendor and they do a quick fix and item works again, but the fault is there. The vendor does not want to refund. My understanding of section 75 of the consumer credit card act 1974 is that the credit card company is liable in this case.

I as yet have not paid the credit card company the money for the item as the credit card statement is not due to be paid in until 20 days from now.

The way I see it is that the credit card company bought the item from the vendor and then gave it to me and if after use I was happy with the item I had to pay for it. If I was not I don't need to pay for the item and give back the item to the credit card company.

Am I in my legal right to withhold payment of the item until the credit card company resolves the issued with the vendor?

Anything sold, at least in the US., has an implied 90 day warranty. Insist on a replacement.

It is up to you to file a claim with the credit card company. Be specific when you file the claim stating the dissatisfaction of the item, your attempt to return it, and the stores refusal to do so.Document the day, times and if possible the store clerks name and response.

Pay your bill, even if you don't want to. The credit card company, if they rule in your favor, will then credit your card, for the amount you claimed. Things like this take time, so be patient.

The way you see it is wrong. The credit card company did not buy the item. You bought the item.



If you don't want to pay, then you give the item back to the vendor, not to the credit card company.

No. You are not entitled to a refund, the seller has to make things right and they did, twice.



Now, had the seller refused to do anything for you....then you could dispute it and succeed. It can take 30-45 days to get a final answer too.



I was able to dispute a laptop charger I bought off ebay via paypal within 6 months because they advertised a 1 year replacement warranty and when I contacted them, they did not respond. So paypal contacted them and they again did not respond so I got the refund. Your seller did all they are required. You would lose.

No, YOU might see it that way, but that's not how it works. The cc company will contact the seller for their side, and when they hear it was fixed, will charge you.

You should go through the dispute process. They should have that available through your account online. You can also call them. While they are investigating, you will not be required to pay that portion of your statement.
